On October 27, 2024, at approximately 9:25 p.m. the driver of a 2023 Mercedez EQS was proceeding northbound on the US-101 with her son as her passenger. As the driver proceeded to a stop in the number two lane of the US-101 to Tujunga Avenue, she came to a stop in her lane, as she prepared to make a right turn onto Tujunga, when she was suddenly rear-ended by the driver of a 2025 Black BMW X7.
Following the impact, the son sought emergency medical care at Sherman Oaks Hospital. At that time, he complained of a headache, back, and neck pain. Having no primary care physician of his own, the son’s worsening condition forced him to eventually seek conservative care in his neighborhood of North Hollywood, California.
The driver (the mother) was seen at an Urgent Care, two days following the collision, on October 29, 2024. At that time, she complained of muscle and chest pain. She underwent diagnostic studies and was provided with a Toradol injection for pain management. She was advised to take over-the-counter pain medication and to consult with her primary care provider.
On February 20, 2025, a time-limited policy limit demand was submitted to Bristol West on behalf of the son. On February 22, 2025, a time-limited policy limit demand was submitted to Bristol West on behalf of the mother. On March 6, 2025, Bristol West tendered their per person limits of $100,000.00 per person to both claimants. Additionally, $5,000.00 was recovered for each claimant from the first party medical payment coverages. As such, $210,000.00 was recovered for the claimants.
