On December 20, 2022, at the intersection of Fairplex Drive and Via Verde in Pomona, California, our client was involved in what is best known as a “he said, she said,” collision. Specifically, our client claimed she was traveling southbound in the number two lane on Fairplex Drive at approximately thirty five miles per hour when she entered the intersection with Via Verde under a green light. The defendant (other driver), claimed that he had the green light was making a left hand turn on Fairplex Drive. The responding Pomona Police Department Officers were unable to determine who ran a red light. The only witness to the collision was our client’s partner which the insurance company’s completely discounted as a biased witness.
In response to a pre-litigation demand, the insurance company refused to pay anything because they viewed this as a “he said, she said” collision with no evidence to prove one side’s account of how the collision took place. In response we filed suit. After filing suit, through aggressive litigation we were able to secure $100,000.00 from the other driver’s insurer who had previously denied liability. We were also able to secure an additional $5,000.00 from our client’s own insurance. In total, we secured $105,000.00 for our client who was very pleased with the overall result.
